Named Chuu has won the last case he filed against Blockberry Creative. The last case that Chuu filed against Blockberry Creative was successful. The validity of Chuu’s exclusive contract, which was contested owing to profit settlements, has been successfully resolved in her lawsuit against Blockberry Creative, her previous agency. Chuu was a member of LOONA. After hearing Blockberry Creative’s appeal to preserve Chuu’s exclusive contract, the Supreme Court’s 3rd Division affirmed the lower court’s decision in Chuu’s favor on June 27. This case will not go to trial again unless there are certain legal grounds, including an unlawfulness in the lower court’s verdict, as the agency’s appeal was rejected. Disputes over profit settlements led Chuu to sue Blockberry Creative in December 2021; in November 2022, he was kicked out of LOONA for bullying. Nevertheless, the claims of bullying were denied by Chuu. At the first trial, Chuu’s legal team claimed that Blockberry Creative’s exclusive contract had exorbitant penalties, including a threefold increase in the agency’s expenses upon contract termination and a fifteen percent cut of the agency’s projected income from entertainment-related endeavors. The court found in favor of Chuu, dismissing Blockberry’s claim that the contract was rendered null and void due to her future actions and signing with ATRP. The court stressed that the contract remained valid notwithstanding the change of agency because it had already established its duration. The court found significant inequities in the distribution of profits and noted that, despite Chuu’s substantial earnings from her entertainment activities from 2016 to September 2021, she was not eligible to receive any settlement funds from Blockberry unless her profits were 40% higher than sales revenue. The court also referenced LOONA’s best-ever financial year in 2019, when the company made 2.88 billion ($2,077,330.18 USD) in sales but only paid out 1.1 billion ($793,424.72 USD), meaning Chuu was out of pocket. Despite Blockberry’s best efforts, the initial decision was sustained by both the appeal court and the Supreme Court, who both determined that it was legally sound.
