Unauthorized use of RIIZE’s picture for Momentica causes controversy

Momentica, a joint venture between HYBE and Dunamu that facilitates the exchange of digital photo cards, got into trouble when it tried to use a singer’s picture without first getting permission from their management organization.

Momentica responded to the uproar by releasing a statement in which it acknowledged the issue brought up by SM Entertainment about the improper use of RIIZE’s picture in social media advertisements. The platform offered SM Entertainment and the fans its heartfelt apologies for the lapse and for not conducting a comprehensive assessment and consultation in advance.

Momentica is an NFT business that lets people buy idol NFTs using lemons. It is run by Levels, a joint venture between HYBE and Dunamu. These NFTs, which digitally recreate the classic photo card that is widely prized among fandoms, usually include videos with the idol’s image or voice.

Though Momentica has mostly included vocalists from HYBE labels such as Seventeen, LE SSERAFIM, and ENHYPEN, RIIZE from SM Entertainment garnered notice as a noteworthy partnership. Later on, though, it became clear that SM Entertainment had not been contacted or included in any conversations about the service or advertising posts.

Given the increasing economic value and relevance of K-pop artists’ intellectual property, an industry insider stressed the need for proper consent when using their works. Failing to do so not only results in infringement but also has legal repercussions, emphasizing the necessity of giving such services serious thought and consulting before releasing them.
