Late Singer Hara’s Mother Loses Inheritance Battle, Constitutional Court Rules

The constitutional court ruled that parents should inherit Hara’s fortune after her mother lost her inheritance dispute.

After Hara died in November 2019, her brother sued their estranged mother for her inheritance. The constitutional court declared almost five years later that family members who don’t fulfill their commitments to deceased family members won’t inherit.

The constitutional court unanimously declared Article 112, Section 4 of the Civil Code unconstitutional on April 25. Family members can inherit under the Civil Code in any situation. However, the court found it impossible to defend siblings’ rights to inherit if they did not contribute to the property.

The Constitutional Court declared Article 112, Paragraphs 1 to 3 of the Civil Code invalid, allowing parents, children, and spouses to inherit. Family members who neglected or abused the deceased are wrong.

The verdict also means Hara’s mother won’t inherit from her fortune.
